The California Department of Education (CDE) Nutrition Services Division (NSD) received approval from the U.S. Department of Agriculture (USDA) to participate in 12 waivers granting needed flexibilities for school year (SY) 2021–2022 operations of the National School Lunch Program (NSLP), the School Breakfast Program (SBP), the NSLP Seamless Summer Option (SSO), and the Child and Adult Care Food Program (CACFP) during the COVID-19 public health emergency. The USDA recognized that having these abilities available for the full SY would allow Child Nutrition Program (CNP) Operators to be more responsive and flexible and to design meal service operations in a way that best suit their operational needs.
For a subset of these flexibilities, including noncongregate meals, parent pick up, and mealtime requirements, the USDA required that they only be used to the extent needed until in-person congregate meals and snacks are able to be resumed safely. As a result, these waivers are collectively referred to as “Limited Use Waivers.” Once selected, they are valid through June 30, 2022 but should be used on an as-needed basis only.
The ability to operate SSO with Summer Food Service Program (SFSP) reimbursement rates, for all family day care home (DCH) providers to receive Tier 1 rates, implement offer versus serve in Senior High Schools, and area eligibility for afterschool programs and DCH providers are collectively referred to as “Annual Waivers,” as they can be used for the full SY.
All meal pattern waiver requests will be reviewed upon submission and approved on a case-by-case basis. Flexibilities are available through June 30, 2022. Meal pattern waivers also require a Meal Pattern Waiver application; links are provided later in this application.
