NSD Initial Waiver Elections

The California Department of Education (CDE) Nutrition Services Division (NSD) received approval from the U.S. Department of Agriculture (USDA) to participate in 12 waivers granting needed flexibilities for school year (SY) 2021–2022 operations of the National School Lunch Program (NSLP), the School Breakfast Program (SBP), the NSLP Seamless Summer Option (SSO), and the Child and Adult Care Food Program (CACFP) during the COVID-19 public health emergency. The USDA recognized that having these abilities available for the full school year would allow Child Nutrition Program (CNP) Operators to be more responsive and flexible and to design meal service operations in a way that best suit their operational needs.
For a subset of these flexibilities, including noncongregate meals, parent pick up, and mealtime requirements, the USDA required that they only be used to the extent needed until in-person congregate meals and snacks are able to be resumed safely. As a result, these waiver elections must be confirmed routinely during the 2021–2022 SY and, in the case of the meal pattern waivers, additional justifications are needed.
All NSLP/SBP, SSO, and CACFP Operators will declare their meal service waiver elections three times over the course of the 2021–22 SY by completing an online application. Meal pattern waivers may be submitted at any time and will be valid only for the period during which they were submitted.

The ability to: operate SSO with Summer Food Service Program (SFSP) reimbursement rates, for all family day care home (DCH) providers to receive Tier 1 rates, implement offer versus serve in Senior High Schools, and area eligibility for afterschool programs and DCH providers are valid for the full 2021–22 SY.
For the subset of waivers with the limited use mandate, waiver elections will be valid for the following three timeframes:
  • Initial waiver elections: July 1, 2021 through December 31, 2021
  • Note that the NSLP, SBP, SSO Meal Pattern waiver (#90) is for the 2021–2022 SY and is valid beginning October 1, 2021
  • Mid-year waiver reelections: January 1, 2022 to March 31, 2022
  • Final waiver reelections: April 1, 2022 to June 30, 2022
